Terms & Conditions
These Terms & Conditions apply to all quotations, sales, rentals, services, deliveries, and agreements supplied by LDS Hire & Sales Ltd unless otherwise agreed in writing by an authorised representative of the company.
By placing an order, purchasing goods, renting equipment, requesting services, or using this website, the customer confirms acceptance of these Terms & Conditions in full.
These Terms & Conditions are intended to provide clarity and protection for both the company and the customer and should be read carefully before entering into any agreement with the company.
General Conditions
Om inte annat uttryckligen skriftligen avtalats med LDS Hire & Sales Ltd, gäller alla offerter, kontrakt, försäljningar, uthyrningar och avtal strikt i enlighet med dessa villkor.
Dessa villkor ska åsidosätta alla alternativa villkor som kunden försöker införa eller införliva, vare sig muntligt, skriftligt, elektroniskt eller genom köpedokumentation.
Godkännande av offert, leverans, produkt, hyrutrustning, faktura eller tjänst som tillhandahålls av företaget utgör godkännande av dessa villkor.
Företaget förbehåller sig rätten att ändra, modifiera, dra tillbaka eller uppdatera offerter och specifikationer utan föregående meddelande om inte annat skriftligen avtalats.
Alla råd, rekommendationer, specifikationer, ritningar eller information som tillhandahålls av företaget tillhandahålls i god tro men utgör inte en del av någon rättsligt bindande garanti om de inte uttryckligen bekräftats skriftligen.
Offerter och beställningar
Alla offerter från LDS Hire & Sales Ltd är beroende av tillgänglighet, leverantörspriser, tillverkningsförhållanden, transportkostnader och materialtillgänglighet vid tidpunkten för orderbekräftelsen.
Om inte annat anges:
Offerter gäller endast under en begränsad period
Priserna kan ändras utan föregående meddelande
Beställningar är inte bindande förrän de har accepterats av företaget
Företaget förbehåller sig rätten att neka eller annullera beställningar efter eget gottfinnande.
Kunderna ansvarar för att säkerställa att alla orderuppgifter, specifikationer, dimensioner, kvantiteter, leveransinformation och krav är korrekta innan bekräftelse.
Eventuella ändringar som begärs efter bekräftelse kan leda till ytterligare avgifter, förseningar, ändrade ledtider eller avbokningskostnader.
Betalningsvillkor
Betalningsvillkoren är strikt 30 dagar från fakturadatum om inte annat skriftligen avtalats.
Underlåtenhet att betala inom avtalade villkor kan leda till:
Avstängning av pågående eller framtida beställningar
Indragning eller minskning av kreditfaciliteter
Avbokning av leveranser eller tjänster
Omedelbar återbetalning av utestående saldon
Vägran av framtida leverans
LDS Hire & Sales Ltd förbehåller sig rätten att debitera ränta på förfallna belopp tillsammans med eventuella juridiska, administrativa, skuldindrivnings- eller inkassokostnader som uppstår vid indrivning av obetalda saldon.
Ränta kan debiteras dagligen på förfallna belopp med den högsta räntesats som är tillåten enligt gällande lag.
Om betalning görs med check, banköverföring, kortbetalning eller någon annan metod som misslyckas, återkallas, avvisas eller är obetald, ska kunden förbli fullt ansvarig för alla därmed sammanhängande kostnader och utestående saldon.
Företaget förbehåller sig rätten att begära hel eller delvis förskottsbetalning för vissa beställningar, specialbeställda produkter, internationella leveranser, varor av högt värde eller kunder utan godkända kreditvillkor.
Prissättning
All prices quoted are subject to applicable taxes, including VAT where required.
Prices are based on costs applicable at the time of quotation and may be adjusted due to:

Supplier cost changes

Currency fluctuations

Manufacturing changes

Freight and delivery costs

Government taxes or duties

The applicable price charged shall be the prevailing price at the time of dispatch, delivery, or invoicing unless otherwise agreed in writing.
There may be a minimum order value requirement; however, no minimum order quantity applies unless otherwise specified.

Additional deliveries
-
Site access restrictions

Re-delivery attempts

Failed collections

International shipments
Retention of Title
Although risk in the goods passes to the customer upon delivery, legal ownership of all goods supplied by LDS Hire & Sales Ltd shall remain with the company until full payment has been received in cleared funds for all outstanding balances owed.
Until ownership transfers, the customer must ensure goods remain:

Properly stored and protected

Fully insured where appropriate

Clearly identifiable as company property
If the customer enters insolvency, liquidation, administration, or breaches payment obligations, the company reserves the right to recover goods without notice and may suspend deliveries or terminate contracts without liability.
Delivery
LDS Hire & Sales Ltd will make every reasonable effort to meet estimated delivery dates; however, delivery dates are estimates only and are not guaranteed. The company shall not be liable for delays or failures caused by supplier shortages, transport delays, accidents, industrial disputes, weather conditions, or other circumstances outside reasonable control.
Claims relating to deliveries must be submitted within the following timeframes:
• Damaged or short deliveries within 3 days of delivery
• Non delivery claims within 10 days of dispatch
Additional transport or handling charges may apply where extra deliveries, failed delivery attempts, amended allocations, or repeat site visits are required.
Cancellation & Returns
Customers are responsible for inspecting goods upon delivery and must notify LDS Hire & Sales Ltd in writing of any defects within 28 days of delivery. Where a defect is confirmed as resulting from faulty manufacture or design, the company may, at its discretion:
• Repair the goods
• Replace defective components
• Replace the goods entirely
• Provide an appropriate credit where applicable
This warranty does not apply to damage caused by misuse, negligence, incorrect installation, unauthorised modifications, transportation damage after delivery, or normal wear and tear.
Limitation of Liability
To the fullest extent permitted by law, LDS Hire & Sales Ltd shall not be liable for indirect or consequential losses, business interruption, loss of profits, project delays, or damages arising from misuse of products or delays caused by third parties.
Nothing within these Terms & Conditions excludes liability where exclusion is prohibited under applicable law.
Website Usage & Intellectual Property
All website content, branding, logos, graphics, technical documents, product descriptions, and marketing materials displayed on this website remain the intellectual property of LDS Hire & Sales Ltd unless otherwise stated.
No content may be copied, reproduced, modified, distributed, or used without prior written permission from the company.
Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms & Conditions shall be subject to the jurisdiction of the courts of England and Wales unless otherwise required by applicable international consumer laws.
LDS Hire & Sales Ltd reserves the right to update or modify these Terms & Conditions at any time without prior notice.
